QWICARGO TRANSPORTATION – Terms of Service

Effective Date: September 2025

QWICARGO TRANSPORTATION (“Company,” “Carrier,” “We,” or “Us”)

1. ACCEPTANCE OF TERMS

By requesting a quote, booking a shipment, or utilizing the services of QWICARGO
TRANSPORTATION, the Customer (Shipper, Broker, or Consignee) agrees to be bound by
these Terms and Conditions. These terms supersede any oral agreements or conflicting terms
provided on a Customer’s Purchase Order or Bill of Lading (BOL).

2. SCOPE OF SERVICE

QWICARGO TRANSPORTATION is a motor carrier providing expedited transport via cargo van.
We do not provide services for:
• Hazardous Materials (HAZMAT) unless expressly agreed upon in writing.
• Household goods (Personal moving services).
• Illegal contraband or prohibited items.
• Shipments exceeding the legal weight and dimension limits of a high-roof cargo van (typically 3,500 lbs).

3. BILL OF LADING (BOL)

The Bill of Lading shall act as a receipt of goods only. If there is a conflict between the BOL and
these Terms and Conditions, these Terms and Conditions shall govern. Any “Special
Instructions” written on a BOL that change Carrier’s liability or service level are not binding
unless signed by an authorized QWICARGO representative.

4. CARGO LIABILITY & LIMITS

• Standard Liability: Carrier’s liability for loss, damage, or destruction to cargo is limited to the
actual value of the goods or $100,000 USD (our standard cargo insurance limit), whichever is
less.
• Exclusions: Carrier is not liable for loss or damage caused by:
• Improper packaging or loading by the Shipper.
• Inherent vice of the goods (e.g., perishable decay).
• “Acts of God,” extreme weather, or public enemy.
• Claims: All claims for damage must be noted on the BOL at the time of delivery. Formal written
claims must be filed within forty-eight (48) hours of delivery.

5. DETENTION & ACCESSORIAL CHARGES

To maintain expedited schedules, QWICARGO enforces the following:
• Free Time: Thirty (30) minutes of free time is allowed for loading and thirty (30) minutes for
unloading.
• Detention: After free time expires, a detention fee of $[Insert Amount, e.g., $50.00] per hour
will be billed in 15-minute increments.
• Cancellations: If a shipment is canceled within [2] hours of the scheduled pickup, a “Truck
Ordered Not Used” (TONU) fee of $[Insert Amount] will apply

6. PAYMENT TERMS

• Invoicing: Invoices are due upon receipt unless “Net [15/30]” terms have been pre-approved in
writing.
• Late Fees: Past due accounts are subject to a late fee of 1.5% per month on the remaining
balance.
• Lien: QWICARGO shall have a possessory lien on any shipments for all sums due to us.

7. FORCE MAJEURE

QWICARGO shall not be liable for any failure to perform, or delay in performing, its obligations if
such failure or delay is due to circumstances beyond its reasonable control, including but not
limited to: traffic congestion, road closures, mechanical breakdowns, or government actions.

8. GOVERNING LAW

These Terms and Conditions shall be governed by the laws of the State of [Your State], without
regard to its conflict of law principles.
